Terms of Service

Effective October 8, 2026

These terms are an agreement between you and Kampy Software LLC, a Wisconsin limited liability company ("we", "us"), for the Petcast apps, their widgets and shortcuts, and petcast.app (together, "Petcast"). By using Petcast you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Petcast.

1. Who can use Petcast

You must be at least 13 years old. If you're under the age of majority where you live, a parent or guardian must agree to these terms for you.

2. What Petcast does

Petcast uses AI services to create daily artwork featuring your pets, based on photos and details you provide and on weather forecasts. AI-made art is imaginative and imperfect: it may not always look exactly like your pets, and the weather shown is a forecast, not a guarantee. Don't rely on Petcast for safety decisions. We may change, add or remove features over time.

3. Your account and household

• Your account is created on your device. Keep your device secure; anyone using it can use your account.
• A household shares its pets, photos, art and settings. Anyone with your invite code can join, see everything in the household and change shared settings. Only share the code with people you trust, and create a new code in Settings if needed.
• You're responsible for what happens in your account.

4. Subscriptions and free trial

• Petcast is offered as an auto-renewing monthly subscription, purchased through the app store you got Petcast from (Apple's App Store, or Google Play once available). The price is shown in the app before you buy.
• New subscribers may get a free trial. Unless you cancel at least 24 hours before the trial ends, your subscription starts and you're charged when the trial ends.
• Your subscription renews automatically each month, and your app store account is charged within 24 hours before the end of the current period, unless you turn off auto-renew at least 24 hours before then.
• Manage or cancel any time in your app store account (on iPhone: Settings → your name → Subscriptions). Cancelling stops future charges; you keep access until the end of the paid period.
• Payments, refunds and billing are handled by the app store under its terms. For Apple purchases, request refunds at reportaproblem.apple.com.
• If prices change, you'll be notified as the app store's rules require, and you can cancel before the new price applies.

5. The shelter giving program

We donate 50% of the Petcast subscription revenue we actually receive from the app stores (that is, after the store's commission and any taxes it withholds) to animal shelters and rescues, as follows:

• Nominations. Each household can nominate one shelter: a local shelter of its choosing or one of the national organizations listed in the app.
• Monthly draw. Each month we pick one nomination at random from all eligible nominations, and that organization receives the donation for that month's revenue. Each household's nomination counts once.
• Eligibility. Recipients must be registered nonprofit organizations (for example 501(c)(3) public charities in the US) whose main work is caring for, rehoming or protecting animals. If a drawn nomination isn't eligible or can't accept a donation, we draw again.
• Timing and reporting. Donations are made after the app stores pay us for that month, which is usually about 30 to 45 days after the month ends. We publish each recipient and amount at petcast.app and let members know in the app or by email.
• Who gives. The donations are made by Kampy Software LLC. Your subscription isn't a charitable donation, and it isn't tax-deductible for you.
• We may change how the program works in the future. If we do, we'll update this section and tell you in the app; changes won't apply to revenue already received.

6. Your content

"Your content" means the photos, pet details, custom style descriptions, feedback and other things you add to Petcast. You keep ownership of your content. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, resize and transmit your content, including to the AI services described in our Privacy Policy, only as needed to run Petcast for you and your household. This license ends when the content is deleted, except for copies in backups that expire on their own schedule. Content you add to a shared household stays with the household if you leave or delete your account, until the household's members delete it or the household is deleted; delete anything you want removed before you go.

You confirm that you have the right to use the photos you upload. Please choose photos of your own pets, and avoid photos where other people can be recognized.

7. The art Petcast makes

As between you and us, we assign to you any rights we have in the art Petcast makes for your household, and you may use it for personal purposes such as wallpapers, gifts and social media. Because AI-made art may not be protected by copyright and similar art could be made for others, we can't promise exclusivity. You give us permission to store the art and show it to your household and to anyone you share a link with. We won't use your photos or your art in our marketing without asking you first.

8. Acceptable use

Don't use Petcast to:

• upload content that's illegal, that you don't have rights to, or that shows animal cruelty;
• write custom styles that are hateful, sexual, violent, or designed to copy a living artist's specific work or someone's trademark;
• try to get around our limits, access other people's households, overload our systems, or reverse engineer or scrape Petcast;
• break any law or anyone else's rights.

We may remove content or suspend accounts that break these rules. To report a shared image or anything else, email support@petcast.app.

9. Third-party services

Petcast relies on other companies, including Apple, Cloudflare, OpenAI, Google and Anthropic, and on weather providers. Their services may sometimes be unavailable, and we're not responsible for them. If we can't make your art on a particular day, we'll try again, but we can't guarantee art every day.

10. Ending your use

You can stop using Petcast and delete your account at any time in Settings. Deleting the app doesn't cancel your subscription; cancel through your app store as described above. We may suspend or end your access if you break these terms or if we stop offering Petcast. If we shut Petcast down, we'll give reasonable notice where we can.

11. Disclaimers

Petcast is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that Petcast will be uninterrupted, error-free, or that forecasts or art will be accurate.

12. Limitation of liability

To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data or profits. Our total liability for any claim relating to Petcast is limited to the greater of the amount you paid for Petcast in the 12 months before the claim or US$50.

Some places don't allow these limits, so they may not fully apply to you. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

13. Governing law and disputes

These terms are governed by the laws of the State of Wisconsin and applicable US federal law, without regard to conflict-of-law rules. Any dispute will be heard in the state or federal courts located in Wisconsin, and you and we consent to their jurisdiction, unless the law where you live gives you the right to bring a claim in your local courts. Before filing a claim, please email us so we can try to resolve it informally.

14. Changes to these terms

We may update these terms. We'll change the date above, and for significant changes we'll tell you in the app before they take effect. If you keep using Petcast after changes take effect, you accept the new terms.

15. Apple-specific terms

If you got Petcast from Apple's App Store:

• These terms are between you and Kampy Software LLC only, not Apple. We, not Apple, are responsible for Petcast and its content.
• Your license to use Petcast is limited to Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for Petcast.
• If Petcast fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent permitted by law, Apple has no other warranty obligation with respect to Petcast. Any other claims, losses, liabilities, damages, costs or expenses due to a failure to conform to a warranty are our responsibility, to the extent not disclaimed in these terms.
• We, not Apple, are responsible for addressing any claims by you or any third party relating to Petcast or your use of it, including product liability claims, claims that Petcast fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• If a third party claims that Petcast or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement and discharge of that claim.
• You confirm that you're not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you're not on any US Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms when using Petcast.
• Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

16. Other terms

If any part of these terms can't be enforced, the rest stays in effect. If we don't enforce a part right away, we haven't waived it. You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. These terms and our Privacy Policy are the whole agreement between you and us about Petcast.
